1. Binding Agreement & Acceptance This website is operated by TechShark ("we", "us", "our"). 6. Nationwide Shipping, Delivery & Force Majeure

• Fulfillment & Couriers: Orders are delivered to physical street addresses across South Africa via recognized courier partners (such as The Courier Guy, Aramex, or equivalent express carriers). Standard estimated transit timelines range from 3 to 11 business days depending on destination routing (main center vs. regional/outlying area).

• Delivery Estimates: Stated delivery windows are good-faith logistical estimates, not strict contractual guarantees. TechShark is not liable for carrier transit delays resulting from regional hub backlogs, customs inspections, adverse weather conditions, strikes, civil disruptions, or force majeure events beyond our direct operational control.

• Transfer of Risk: Risk of loss and physical damage to goods passes to the Customer upon verified handover by the courier to the delivery address provided at checkout.

7. Inspection, Transit Damage & Defective Goods Remedy

• 48-Hour Transit Damage Notification: You must inspect the external shipping parcel and internal contents upon delivery. Any physical transit damage (e.g., cracked housings, crushed components) or missing items must be reported in writing within 48 hours of courier handover to info@techshark.co.za with supporting photos of the outer carton, courier waybill, and affected goods.

• Statutory Defect Warranty (Consumer Protection Act Section 56): In accordance with the CPA, all electronic and mechanical goods carry an implied statutory warranty of quality covering manufacturing defects for up to six (6) months from purchase:

  • If a product develops a verified internal malfunction or manufacturing defect during normal, intended use within this warranty period, it will be evaluated by our technical team.

  • Upon verification of a genuine manufacturing fault, you are entitled to your choice of a repair, an identical replacement unit, or a full refund back to your original payment method.

• Warranty Exclusions: This statutory remedy strictly excludes issues arising from normal wear and tear, physical drops or impact damage, unauthorized product modifications or opening of casings, water ingress exceeding rated IP specifications, use of improper power adapters, electrical power surges/load-shedding spikes, or operation contrary to supplied user instructions.

• Dispatched Orders: Change-of-mind cancellations or buyer's remorse returns are not accepted once an order has been dispatched.

9. Medical, Health & Wellness Disclaimer & Liability Release

• Non-Clinical, Lifestyle Use Only: Health, biometric, and monitoring devices sold by TechShark (including digital blood pressure monitors, pulse oximeters, and fitness tracking devices) are intended strictly for general personal fitness tracking and non-clinical home reference. They are not certified medical-grade diagnostic instruments, hospital monitors, or life-support equipment.

• No Medical Relationship: Nothing published on our site—including manuals, descriptions, or informational summaries—constitutes clinical, diagnostic, or medical advice. No communication or sale establishes a doctor-patient or certified medical relationship.
