1. Binding Agreement & Acceptance

You may not use our products or services for any unauthorized, illegal, or illicit purpose, nor violate any municipal, national, or international laws (including intellectual property laws).

3. Product Descriptions, Accuracy & Visual Variations

  • Visual Disclaimers: We make every effort to display the colors, finishes, and features of our products (including smart bins and portable blending tumblers) as accurately as possible. However, display screens, lighting conditions, and monitors render colors differently; we cannot guarantee that your device's display of any color (e.g., Cream Beige, Pastel Mint, or Matte White) will be completely color-accurate.

  • Typographical Errors & Adjustments: Product specifications, dimensions (e.g., metric volume, height, diameter), and pricing are subject to correction without notice. We reserve the right to correct any typographical inaccuracies, errors, or omissions, and to modify, update, or cancel orders if any information on the website is inaccurate at any time without prior notice (even after an order has been submitted).

4. Orders, Pricing & Merchant Right to Refuse Service

  • Right of Cancellation: Receipt of an automated order confirmation email does not constitute a legally binding acceptance of an order. We reserve the sole and absolute discretion to refuse, limit, or cancel any order placed with us for any reason, including suspected fraudulent activity, bulk unauthorized reseller purchases, pricing errors, or inventory unavailability.

  • Pricing Adjustments: All product prices are displayed in South African Rand (ZAR) unless explicitly stated otherwise. We reserve the right to alter pricing, introduce surcharges, or discontinue products at any time without liability.

5. Payment Processing & Verification

  • Secure Gateways: Payment must be settled in full prior to order processing and dispatch. All transactions are securely processed via certified, PCI-DSS compliant third-party gateways (including Yoco).

  • No Direct Card Storage: We do not store or process complete credit or debit card details on our local servers.

  • Chargeback & Fraud Clause: Any fraudulent chargeback, false non-delivery dispute, or bad-faith transaction dispute initiated through your issuing bank without first contacting our customer support within the designated policy frameworks will be treated as a breach of contract and pursued legally, including administrative and recovery cost recovery.

6. Nationwide Shipping, Delivery & Force Majeure

  • Delivery Timelines: Orders are dispatched to physical addresses across South Africa via our designated courier partners (e.g., Aramex). The standard estimated delivery timeline is 8 to 11 business days.

  • Estimations Only: Delivery dates and lead times are good-faith estimates, not strict contractual guarantees. We are not liable for transit delays caused by third-party logistics carriers, regional transit hubs, customs clearance, adverse weather, civil unrest, or force majeure events.

  • Transfer of Risk: Risk of loss and title for all merchandise pass to you upon successful delivery by the courier to the delivery address nominated at checkout.

7. Strict Inspection, Damage & Defect Remedy (No-Refund Policy)

  • 48-Hour Inspection Mandate: You must inspect all merchandise immediately upon receipt. Any defect, operational malfunction, transit damage, or missing component must be reported in writing with photo and video proof within forty-eight (48) hours of carrier delivery confirmation. Failure to notify us within 48 hours constitutes full deemed acceptance of the product in good working condition.

  • Strict Remedy: As outlined in our Return Policy, we operate a strict No Cash/Card Refund and No Exchange policy. The sole and exclusive remedy for an approved manufacturer defect or verified transit damage is product repair or a direct unit replacement of the identical variant at our sole discretion.

8. Safe Operation & Product Usage Disclaimer

  • Proper Handling: Customers are solely responsible for reading all user instructions and operating mechanical and electrical products (such as high-speed 10-blade portable blenders and sensor-activated bins) safely.

  • Misuse Disclaimers: We disclaim all responsibility for personal injury, property damage, water damage, or motor burnout caused by overfilling vessels, blending prohibited hard non-food items, immersing motorized motor caps beyond IP specifications, charging with substandard third-party power adapters, or tampering with internal components.

9. Intellectual Property Protection
All content, product photography, editorial imagery, branding, logos, graphics, text, layout styling, and digital assets on this website are the exclusive intellectual property of the merchant or licensed to us. No reproduction, copying, distribution, scraping, framing, or commercial exploitation of any site content is permitted without our express, prior written authorization.

10. Disclaimer of Warranties & Comprehensive Limitation of Liability

  • "As Is" Basis: To the fullest extent permitted by applicable South African law, our products and services are provided on an "as is" and "as available" basis without any representations, warranties, or conditions of any kind, whether express or implied.

  • Maximum Liability Cap: In no event shall the business, our owners, directors, employees, affiliates, or agents be liable for any indirect, punitive, incidental, special, or consequential damages—including lost profits, lost revenue, personal injury, property damage, or data loss—arising from your use of any product or service purchased through this website.

  • Financial Cap: Our total, cumulative aggregate liability to you under any legal theory (whether in contract, delict, or strict liability) shall never exceed the actual purchase price paid by you for the specific product giving rise to the claim.

11. Indemnification
You agree to defend, indemnify, and hold harmless the merchant, our affiliates, partners, officers, and contractors from and against any claims, liabilities, damages, losses, costs, and legal fees arising out of or in any way connected with your breach of these Terms, your misuse of any product, or your violation of any applicable law or third-party rights.

12. Severability & Entire Agreement
If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by law, and the remainder of the Terms shall remain fully valid, binding, and enforceable. These Terms, together with our Return Policy and Privacy Policy, constitute the entire agreement between you and the merchant.

13. Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you products or services shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the relevant South African courts in the event of any legal proceeding or dispute.
